SIOUX FALLS, S.D. (MITCHELLNOW) The Moody County murder trial of Joseph Hoek is on hold as his attorneys request a change of venue. The Sioux Falls man is accused of hitting and killing Chief Deputy Sheriff Ken Prorok in February of last year. His lawyers argue he can’t get a fair trial locally and want the case moved out of Moody County. During a hearing this week, prosecutors called over a dozen witnesses, including Hoek’s family and medical staff. Testimony also focused on Hoek’s mental health and a voicemail where he allegedly threatened to kill relatives. The judge is expected to decide on the venue request by October 3rd. A trial date will be set afterward. Attorney General Marty Jackley says the state will seek the death penalty if Hoek is convicted. For more crime stories from MitchellNow.com, click here.
